I am writing this letter in concern regarding the reprimanding of a councilman of the Ute Tribe Mr. Richard Jenks Jr was suspended from office for (90) day period.

In-accordance with the Constitution and By-laws, & Ordinance No. 90-01 Code of Ethics.

Thus Code of Ethics and Constitution both mandates.

Section 3-1 Administrative Sanctions:

A written complaint shall be filled by the complaining party setting out the exact allegations regarding any and all violations of the Ute Indian Tribes’ Code of Ethics within fifteen days of the filling of said complaint set a closed hearing the subject of said complaint. Upon final determination, an opportunity for a hearing, finding and review, if the committee finds any provision of this ordinance: The committee, upon due consideration of the “seriousness” of the violation or offense may order or impose any and all of the following sanctions and penalties:

3. Suspension from public office or employment and/or forfeiture of compensation and benefits, upon such terms and conditions that the Ute Tribe Business Committee shall deem appropriate. No suspension from public office or forfeiture of compensation and benefits shall be for more than a two (2) week period.

The Councilman has failed to uphold the Tribal Constitution and By-Laws & Code of Ethics to property exercise the will of the people through the adoption of appropriated By-Laws and Constitutional Amendments. The sanctions of (90) days is excessive and un-constitutional and morally un-ethical.

At a General Meeting of Uncompahgree band Members Dated November 22, 2011 both Representatives of the Uncompahgree Band was requested to attend upon which these matters were to be discussed in an open debate. The Consensus of the Band Members was that the sanctions of (90) days is excessive and un-constitutional and morally un-ethical.

The Uncompahgree Members is written this letter in-lure of its upcoming meeting on December 06, 2011 and requesting that Mr. Richard Jenks Jr be re-instated in-accordance with the Constitution and By-Laws & Code of Ethics mandated.
